Acceptance of Terms

By accessing and using the services provided by brandarchitect S.L. ("we", "our", or "us"), you agree to be bound by these Terms of Service ("Terms"). These Terms constitute a legally binding agreement between you and brandarchitect regarding your use of our fitness facilities, services, website, and related offerings. If you do not agree to these Terms, please do not use our services.

brandarchitect S.L. is a fitness studio company registered in Spain with registration number B58294061 and VAT number ESB73920615. Our registered office is located at Calle Cervantes 119, 48957 Bilbao, Basque Country, Spain. We provide fitness services including personal training, group classes, nutrition coaching, and related wellness services.

Services Description

brandarchitect provides fitness and wellness services including but not limited to personal training sessions, group fitness classes, nutrition coaching, fitness assessments, and access to our fitness facilities. All services are subject to availability and may be modified or discontinued at our discretion with reasonable notice to members.

Membership and Registration

To access our services, you must register for a membership and provide accurate, current, and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must be at least 16 years old to register for a membership. Members under 18 require parental or guardian consent.

User Obligations

As a member of brandarchitect, you agree to comply with all facility rules, safety guidelines, and codes of conduct. You are responsible for your own safety and the safety of others while using our facilities and services.

Specifically, you agree to:

  • Follow all posted rules and staff instructions
  • Use equipment properly and safely
  • Respect other members and staff
  • Maintain appropriate hygiene and dress code
  • Not engage in disruptive or inappropriate behaviour
  • Report any injuries or incidents immediately
  • Keep your membership information current
  • Pay all fees and charges on time

Health and Safety

You acknowledge that physical exercise involves inherent risks and that you participate in our services at your own risk. You represent that you are in good health and have no medical conditions that would prevent safe participation in fitness activities. We recommend consulting with a healthcare provider before beginning any exercise programme. You agree to inform us of any health conditions or limitations that may affect your ability to safely participate in our services.

Payment Terms

Membership fees and service charges are due in advance and must be paid according to the payment schedule agreed upon at the time of registration. We accept various payment methods as specified during registration. Late payments may result in suspension of services and additional fees. All fees are non-refundable unless otherwise specified in writing or required by applicable law.

Cancellation and Refunds

Membership cancellations must be submitted in writing with appropriate notice as specified in your membership agreement. Refund policies vary by membership type and are subject to applicable consumer protection laws. Personal training sessions and other services may have specific cancellation policies that will be communicated at the time of booking.

Intellectual Property

All content, materials, trademarks, logos, and intellectual property associated with brandarchitect are owned by or licensed to brandarchitect S.L. You may not use, reproduce, distribute, or create derivative works from our intellectual property without express written permission. The brandarchitect name, logo, and all related marks are trademarks of brandarchitect S.L.

Privacy and Data Protection

Your privacy is important to us. Our collection, use, and protection of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using our services, you consent to the collection and use of your information as described in our Privacy Policy.

Limitation of Liability

To the fullest extent permitted by law, brandarchitect S.L., its directors, employees, and agents shall not be liable for any direct, indirect, incidental, special, or consequential damages arising from your use of our services or facilities. This includes but is not limited to damages for personal injury, property damage, loss of profits, or other losses. Our total liability to you for any claims arising from these Terms or your use of our services shall not exceed the amount you have paid to us in the twelve months preceding the claim.

Indemnification

You agree to indemnify, defend, and hold harmless brandarchitect S.L. and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses arising from your use of our services, your violation of these Terms, or your violation of any rights of another person or entity.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of Spain. Any disputes arising from these Terms or your use of our services shall be subject to the exclusive jurisdiction of the courts of Bilbao, Spain. If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.

We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on our website and updating the "last updated" date. Your continued use of our services after any modifications constitutes acceptance of the updated Terms. We encourage you to review these Terms periodically.

Termination

We reserve the right to suspend or terminate your membership and access to our services at any time, with or without cause, and with or without notice. Grounds for termination include but are not limited to violation of these Terms, non-payment of fees, disruptive behaviour, or any conduct that we deem harmful to our business or other members. Upon termination, your right to use our services will cease immediately.

Force Majeure

brandarchitect shall not be liable for any failure or delay in performance of our obligations under these Terms due to circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, labour disputes, government regulations, or public health emergencies.

Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable, the validity, legality, and enforceability of the remaining provisions shall not be affected or impaired, and such provision shall be deemed modified to the minimum extent necessary to make it valid, legal, and enforceable.

Entire Agreement

These Terms, together with our Privacy Policy and any additional terms specific to certain services, constitute the entire agreement between you and brandarchitect regarding your use of our services and supersede all prior agreements and understandings, whether written or oral.
